Fraudulent conveyance -- transfers fraudulent as to creditors -- between husband and wife. 1. Where a transfer of property will render the transferor insolvent, such transfer is fraudulent as to creditors without regard to the transferor's actual intent if the conveyance is made without a fair consideration. And where the rights of creditors come into question, each spouse will be held to have notice of the contracts and debts of the other as fully as if a party thereto.
